By accessing or using Fyncall's AI-powered customer service platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
Fyncall provides an AI-powered customer service platform for e-commerce businesses, including but not limited to:
- AI-powered conversation handling across multiple channels
- Integration with e-commerce platforms (Shopify, etc.)
- Customer support automation tools
- Analytics and reporting features
- Team collaboration tools
3. Account Registration
To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Violate any applicable laws or regulations
- Infringe on the rights of others
- Transmit harmful code or interfere with the Service
- Attempt to gain unauthorized access to any systems
- Use the Service to send spam or unsolicited communications
- Misrepresent your identity or affiliation
5. Intellectual Property
The Service, including all content, features, and functionality, is owned by Fyncall and protected by intellectual property laws. You retain ownership of your data and content uploaded to the Service.

7. Payment Terms
If you subscribe to a paid plan, you agree to pay all applicable fees. Fees are non-refundable except as required by law or as specified in your subscription agreement. We reserve the right to change pricing with reasonable notice.
8. Service Level Agreement
We strive to maintain high availability for our Service. Specific SLA terms may be included in your enterprise subscription agreement. Credits for downtime may be available for qualifying outages.
9. AI and Automation
Our Service uses artificial intelligence to automate customer interactions. While we strive for accuracy, AI-generated responses may occasionally contain errors. You are responsible for reviewing and approving AI configurations and maintaining appropriate human oversight.
10. Third-Party Integrations
The Service may integrate with third-party platforms (Shopify, WhatsApp, etc.). Your use of these integrations is subject to the respective third-party terms. We are not responsible for third-party services or their availability.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FYNCALL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
12. Indemnification
You agree to indemnify and hold Fyncall harmless from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.
13. Termination
Either party may terminate this agreement at any time. Upon termination, your right to use the Service ceases immediately. We will provide reasonable opportunity to export your data before permanent deletion.
14. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
15. Governing Law
These Terms shall be governed by the laws of the jurisdiction in which Fyncall is incorporated, without regard to conflict of law principles.
